Terms of Service

1. Agreement to these terms

By using JobSwitch, you agree to these Terms of Service. If you do not agree, do not use the service. If you are using JobSwitch on behalf of an organization, you confirm you have the authority to bind that organization to these terms.

2. What JobSwitch does

JobSwitch is a beta AI agent that searches for roles, drafts applications, and submits them to employers on your instruction — through WhatsApp. The agent acts on your behalf and under your authority. JobSwitch is not an employer, recruiter, staffing agency, or employment intermediary. We do not guarantee any job, interview, or response.

3. Eligibility

• You must be at least 18 years old.
• You must be legally able to work in any role you ask the agent to apply to.
• The information you give the agent must be true, accurate, and your own.

4. Your account

One account per person. Your WhatsApp number is your primary identifier. Keep access to that number and to any email associated with your account secure. You are responsible for all activity that takes place through your WhatsApp number on JobSwitch.

5. Your content and the rights you grant us

You own your resume, your profile, and the messages you send the agent. By using JobSwitch, you grant us a non-exclusive, worldwide, royalty-free license to use that content solely to operate the service for you — that is, to read your profile, search for roles, draft applications, and submit them to employers you direct us to.

We do not have the right to sell your content, sublicense it for unrelated purposes, or use it to train third-party models.

6. Acceptable use

You agree not to:

• Misrepresent your identity, credentials, work history, or eligibility.
• Spam employers, send abusive content, or use the service to harass anyone.
• Use JobSwitch to apply on behalf of another person without their explicit authorization.
• Scrape, reverse-engineer, or attempt to extract source code or training data from the service.
• Interfere with the service, attempt to bypass rate limits, or test it for vulnerabilities outside an authorized program.

Some job boards and ATSs prohibit automated applications in their own terms of use. You are responsible for understanding the terms of the platforms you ask JobSwitch to apply through.

7. Agent autonomy and your responsibility

When the agent submits an application on your behalf, you are the applicant of record. The agent acts on your authority and on the preferences and instructions you have given it. Where the product allows, you can review and approve drafts before they are sent.

You are responsible for the truth and completeness of any application submitted under your name. JobSwitch is not responsible for the content of applications you direct the agent to send, or for any consequences with employers that result from those applications.

8. Beta service

JobSwitch is in active beta. The service is provided as-is and may change, break, or be paused without notice. We do not offer a service-level agreement during beta. Features may be added, modified, or removed.

9. Fees

JobSwitch is free during the beta period. Paid plans may be introduced later. We will give you reasonable notice before any fees apply to you, and you can stop using the service at any time before they do.

10. Third-party services

JobSwitch uses WhatsApp, large language model providers, job boards, applicant tracking systems, and other third-party services. Your use of those services through JobSwitch is also subject to their own terms. We are not responsible for the availability, accuracy, or behavior of third-party services.

11. Disclaimers

To the maximum extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.

We do not warrant that the service will get you a job, an interview, or any response from an employer. We do not warrant that agent-generated content is free of errors or omissions. You should review drafts where the product gives you the option, and you remain the applicant of record either way.

12. Limitation of liability

To the extent permitted by Indian law, JobSwitch's total liability arising out of or related to the service is capped at the greater of (a) the fees you paid to us in the 12 months before the event giving rise to the claim, or (b) ₹1,000 (which applies during beta when no fees are charged).

We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost employment opportunities, lost profits, lost data, or loss of goodwill, even if advised of the possibility.

13. Indemnification

You agree to indemnify and hold JobSwitch harmless from any claims, damages, or expenses arising out of (a) your use or misuse of the service, (b) the content of applications you direct the agent to submit, (c) your misrepresentations or violation of these terms, or (d) your violation of any third-party right or applicable law.

14. Termination

You may stop using JobSwitch at any time. To delete your account, message the agent on WhatsApp or email hi@jobswitch.app. We may suspend or terminate your access if you breach these terms or if we discontinue the service. During beta, we may also pause or end the service for any reason on reasonable notice.

15. Governing law and disputes

These terms are governed by the laws of India. The courts located in Bengaluru, India have exclusive jurisdiction over any dispute arising out of or related to the service or these terms, subject to applicable consumer-protection laws in your jurisdiction.

16. Changes to these terms

We may update these terms. For material changes, we will give you at least 30 days' notice via email and WhatsApp. If you keep using the service after the new terms take effect, you accept them. If you don't agree, stop using the service before the effective date.
